As a DUI/DWI defense lawyer, I have successfully challenged RBT (roadside breath-testing) devices, resulting in THOUSANDS of breath tests being ruled inadmissible. I have also challenged on-standardized blood test procedures, non-scientific field sobriety tests and other government "science” used as evidence in DUI cases.

  • First offense DUI/DWI: A conviction means 10 days in jail (nine of which can be suspended). If the charge is extreme DUI (where the alcohol concentration was .15 or more), the sentence is for 30 days in jail, or 45 days if the concentration exceeds .20.
  • Subsequent DUI convictions: A second conviction within seven years means a minimum of 30 days in jail. A second extreme DUI within seven years requires a minimum 60 days in jail. Third offenses or any DUI committed with a suspended or revoked license is treated as a felony with mandatory imprisonment.
  • The consequences: In addition to jail time and driver's license revocation or suspension, DUI convictions carry heavy fines, chemical dependency assessments, mandatory alcohol-education classes, increased insurance rates and a criminal record.
